AL.com: “The Alabama Senate [Tuesday] passed bill to prohibit racial profiling that would require police to keep records of traffic stops intended to show whether profiling is happening.
The bill is by Sen. Rodger Smitherman, a Democrat from Birmingham, who has sponsored bills to prohibit racial profiling for more than a decade.
Under his legislation, city, county, and state law enforcement would adopt written policies to prohibit racial profiling.
That policy would prohibit “the stopping, detention, or search of any motorist when the action is solely motivated by considerations of race, color, ethnicity, age, gender, or sexual orientation, and the action would constitute a violation of the civil rights of the motorist.”
Law enforcement agencies would keep records of the race, gender, and age of motorists involved in traffic stops and whether the traffic stop led to a warning, ticket, arrest, or search.
The information would be reported to the attorney general. The attorney general could order or recommend withholding funds from the agency if it is determined that racial profiling is taking place.”
